Terms of Sale
Please read these Terms of Sale before placing an order. They explain who we are, how contracts are formed, delivery arrangements, subscriptions, cancellations, returns and your legal rights. These terms do not affect rights that cannot lawfully be excluded or restricted.
1. About us and how to contact us
1.1 We are Just Bru Ltd, trading as Harmony Coffee (we, us and our), a company registered in England and Wales under company number 12566408. Our VAT registration number is GB 503 7649 89.
1.2 Our registered office is Basepoint Business Centre, 1 Winnall Valley Road, Winchester, Hampshire, United Kingdom, SO23 0LD.
1.3 Our trading and returns address is Harmony Coffee, 6 Concept Court, York, YO30 4XF.
1.4 You may contact us using the contact form at harmonycoffee.co.uk or by emailing hello@harmonycoffee.co.uk. If we need to contact you, we will use the email address, telephone number or postal address supplied with your order.
2. When these terms apply
2.1 These terms apply to purchases made by consumers through harmonycoffee.co.uk. They do not apply to wholesale or other business-to-business purchases, which are subject to separate terms.
2.2 You must be at least 18 years old and legally capable of entering into a contract to place an order.
2.3 If mandatory consumer law in your country gives you additional rights, those rights are not affected by these terms.
3. Our products
3.1 Product descriptions, available weights, grind options, prices, subscription choices and other important information are shown on the relevant product page. Images and colours are illustrative and may display differently on different devices.
3.2 Coffee is an agricultural product. Natural variations between harvests, batches and roast dates may result in reasonable differences in appearance and flavour. These variations do not affect your rights where a product is faulty or not as described.
3.3 You are responsible for selecting the correct product, quantity, grind size, delivery address and subscription option before submitting your order. Please contact us promptly if you identify an error.
3.4 Required food information is provided on the product page and/or packaging, as applicable. Please follow the storage and preparation information supplied with the product.
4. Orders and formation of the contract
4.1 The website guides you through the steps required to place an order and allows you to review and correct information before submitting it. The checkout button makes clear that placing the order involves an obligation to pay.
4.2 Your order is an offer to buy the products in your basket. An automated acknowledgement confirms that we have received the order; it does not necessarily mean that we have accepted it.
4.3 The contract is formed when we send an order confirmation accepting your order. We will provide the contract information in a form that you can retain, normally by email.
4.4 We may decline or cancel an order before dispatch if, for example, a product is unavailable, we cannot authorise payment, we cannot deliver to the address supplied, an obvious pricing or description error has occurred, purchase limits have been exceeded, or we reasonably suspect fraud or misuse. If payment has been taken, we will refund it.
5. Prices and payment
5.1 Prices are those displayed when you place your order and include VAT where applicable. Delivery charges and the final order total are displayed before you commit to pay.
5.2 We accept the payment methods displayed at checkout. Payment may be processed by a third-party payment provider. You confirm that you are authorised to use the payment method supplied.
5.3 If a pricing error is obvious and could reasonably have been recognised as an error, we may cancel the order and refund any sums paid. We will normally contact you before doing so.
5.4 Promotional codes and discounts are subject to any stated conditions, cannot be exchanged for cash and may not be combined unless expressly permitted.
6. Delivery
6.1 Available delivery destinations, methods, charges and estimated delivery times are displayed at checkout. We only accept an order where the website makes delivery available to the selected destination.
6.2 Delivery dates are estimates unless we expressly agree a fixed date. We will deliver without undue delay and, for UK consumer orders, no later than 30 days after the contract is formed unless a different period has been agreed with you.
6.3 You are responsible for providing a complete and accurate delivery address. If delivery cannot be completed because of incorrect information, failure to collect or refusal of delivery, we may charge reasonable additional delivery or return costs where the law permits.
6.4 Responsibility for the products passes to you when they are delivered to you, or to a person identified by you to receive them. Ownership passes once we have received payment in full.
6.5 For international orders, you are responsible for complying with destination-country import requirements and for paying any import VAT, customs duty, clearance fee or other charge imposed by local authorities or carriers. These charges are not included unless the checkout expressly says otherwise. We are not responsible for customs delays outside our reasonable control.
7. Changing or cancelling an order before dispatch
7.1 Contact us as soon as possible if you wish to change or cancel an order. We will try to help, but we cannot guarantee that a change or cancellation can be made once processing, grinding, packing or dispatch has begun.
7.2 If we cannot stop an order, you may still have cancellation and return rights under clause 8.
8. Change-of-mind cancellations and returns
8.1 Statutory cancellation right. Where the law gives you a right to cancel a distance contract, you may notify us within 14 days beginning on the day after the products are delivered. You do not need to give a reason. If one order is delivered in separate instalments, the period normally begins after the final instalment is delivered.
8.2 Harmony's extended return promise. In addition to your statutory rights, we accept change-of-mind returns notified within 32 days of purchase, provided the coffee or other product is unopened, unused, sealed in its original packaging and suitable for resale. If the statutory 14-day period after delivery ends later, that statutory period will still apply.
8.3 To cancel, submit the website contact form, email hello@harmonycoffee.co.uk, or use the model cancellation form in the appendix. You do not have to use the model form. Your notice must clearly identify you and the relevant order.
8.4 After notifying us, return the products without undue delay and no later than 14 days after the cancellation notice. Please obtain proof of postage and send approved returns to Harmony Coffee, 6 Concept Court, York, YO30 4XF. Do not send returns to our registered office.
8.5 You are responsible for the direct cost of a change-of-mind return. We will pay or reimburse reasonable return costs where products are faulty, damaged, misdescribed or incorrectly supplied, subject to clause 9.
8.6 For a valid cancellation of the whole order, we will refund the product price and the cost of our least expensive standard delivery option. We do not have to refund the additional cost of an upgraded delivery service. For partial returns, the original delivery charge may not be refundable.
8.7 We will make the refund using the original payment method unless agreed otherwise, normally within 14 days after we receive the returned goods or you provide evidence that they were sent back, whichever is earlier. We may withhold the refund until then where permitted.
8.8 During the statutory cancellation period, you may inspect goods as you reasonably could in a shop. We may reduce a refund to reflect loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Harmony's additional 32-day promise applies only to unopened and unused products.
8.9 Cancellation rights may not apply to products made to your specification or clearly personalised, goods liable to deteriorate or expire rapidly, or sealed goods that are unsuitable for return for genuine health-protection or hygiene reasons once unsealed. We will only rely on an exception where it lawfully applies and will identify any relevant restriction before purchase where required.
9. Faulty, damaged or incorrect products
9.1 Products must be as described, of satisfactory quality and fit for any purpose made known to us. Nothing in these terms limits your statutory rights.
9.2 Inspect your delivery as soon as reasonably possible and contact us promptly if anything is missing, damaged, faulty or incorrect. Please provide your order number and, where reasonably requested, photographs or other information that helps us investigate.
9.3 Depending on the circumstances and your legal rights, we may provide a replacement, refund, price reduction or another appropriate statutory remedy. We will cover reasonable return costs for products that are faulty, damaged, misdescribed or incorrectly supplied.
10. Ongoing subscriptions
10.1 An ongoing subscription renews automatically at the delivery and billing frequency selected at checkout until it is cancelled. The product page and checkout show the price, frequency and any minimum commitment before purchase.
10.2 Subscription payments are charged automatically to your selected payment method. If payment fails, we or our payment provider may retry the payment, ask you to update your payment details, postpone the dispatch or suspend the subscription.
10.3 You may manage, pause, skip, change or cancel an ongoing subscription through your customer account, subject to the options available there, or by using the contact form on our website.
10.4 To prevent the next scheduled dispatch, a cancellation or change must be completed or received at least 24 hours before that dispatch. A request received later may take effect from the following dispatch because the next order may already be processed, ground or packed. There is no cancellation fee.
10.5 If we change an ongoing subscription's price or another material term, we will give reasonable advance notice. You may cancel before the change takes effect. Product availability may vary; if a selected coffee becomes unavailable, we will contact you, offer a reasonable substitute where the subscription description permits this, or provide an appropriate refund.
11. Fixed-length and gift subscriptions
11.1 A fixed-length or gift subscription runs for the number of deliveries or period shown at checkout and ends automatically. It will not renew unless the product page and checkout clearly state otherwise and the purchaser has expressly chosen renewal.
11.2 Delivery dates and recipient details should be checked carefully before purchase. Contact us promptly if they need changing. We will try to accommodate changes before the relevant dispatch but cannot guarantee changes requested less than 24 hours before dispatch.
11.3 Cancellation rights and refunds for fixed-length subscriptions are governed by clauses 8 and 9 and applicable law. Where part of a subscription has already been supplied, any refund will take account of products lawfully supplied before cancellation.
12. Events outside our reasonable control
12.1 We are not responsible for delay or failure caused by an event outside our reasonable control. We will take reasonable steps to minimise the effect, keep you informed where appropriate and arrange delivery as soon as reasonably possible.
12.2 If a significant delay occurs, you may have the right to cancel and receive a refund for products not supplied.
13. Our responsibility to you
13.1 We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. Loss is foreseeable if it was an obvious consequence or was contemplated by both parties when the contract was made.
13.2 We supply products for private use. If you use them for commercial, business or resale purposes, we are not responsible under these consumer terms for business losses, including loss of profit, revenue, business or opportunity. Separate wholesale terms may apply.
13.3 Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of rights that cannot legally be restricted.
14. Personal information
14.1 We use personal information in accordance with our Privacy Policy and Cookie Policy, available on harmonycoffee.co.uk.
15. Complaints
15.1 If you have a complaint, please contact us through the website contact form or email hello@harmonycoffee.co.uk. Include your order number and enough information for us to investigate. We will try to resolve the matter fairly and promptly.
15.2 These terms do not prevent you from using any court, regulatory, alternative dispute-resolution or other remedy available under applicable law.
16. Other important terms
16.1 We may transfer our rights and obligations under a contract to another organisation, but this will not reduce your rights. You may only transfer your rights or obligations with our written agreement, except where the law permits otherwise.
16.2 Each contract is between you and us. No other person has a right to enforce it, except anyone to whom rights are validly transferred.
16.3 If a court finds part of these terms unlawful, the remaining provisions will continue in effect.
16.4 A delay in enforcing a right does not waive that right.
16.5 We may update these terms from time to time. The terms in force when your order is accepted will apply to that order. For ongoing subscriptions, we will give reasonable notice of material changes before they take effect.
17. Governing law and courts
17.1 These terms and contracts made under them are governed by the laws of England and Wales. If you live in Scotland, Northern Ireland or another country, you retain any mandatory protections provided by the law of your home jurisdiction.
17.2 You may bring proceedings in the courts of England and Wales or, if applicable consumer law permits, in the courts of the part of the United Kingdom or country where you live. We may bring proceedings against you only as permitted by applicable law.
